Distance sales agreement

1. Parties — Seller (service provider): EFİ Hizmet Danışmanlık Eğitim ve Aracılık Hizmetleri Limited Şirketi; Address: Aydınlıkevler Mah. Sokullu Cad. No: 62 B, Melikgazi / Kayseri; Tax office / no: Mimarsinan / 3251199651; E-mail: kurumsal@personel.net; Web: https://personel.net. Buyer: the natural or legal person who buys a package on personel.net with an employer account; the buyer's name, address and tax details are taken from the billing details on their account at the time of purchase.

2. Subject — This agreement sets out the rights and obligations of the parties for the sale and performance of the digital services the buyer orders electronically on the personel.net website. It is concluded when the buyer confirms the order on the payment page.

3. Service and price — What is sold is not physical goods but digital rights used on the personel.net platform: job posting rights (each job stays live for 30 days from going live), featuring rights (the job is shown at the top of listings for 7 days), urgent job rights (the job is marked "urgent" for 7 days) and advertising balance (used for ad campaigns on the platform). The package contents and the total price including VAT are shown on the Packages page and on the payment page before purchase; the price that applies is the one at the time the order is confirmed.

4. Payment — Payment is taken by credit or debit card through a licensed payment institution (PayTR or iyzico). Card details are not seen or stored by personel.net. Instalment options are shown on the payment page depending on your bank.

5. Delivery (performance) — The service is performed electronically and immediately: as soon as the payment is confirmed, the purchased rights are added to the buyer's employer account and shown under Employer panel → Packages. There is no physical delivery or shipping. Rights stay on the account without expiry; the job, featuring and urgent periods start when a right is used.

6. Invoice — An invoice for the service is issued to the billing details on the buyer's account and sent electronically. The buyer is responsible for the accuracy of the billing details.

7. Right of withdrawal — Because the service is performed electronically and immediately upon payment, there is no right of withdrawal under Article 15(ğ) of the Turkish Regulation on Distance Contracts. By confirming the order, the buyer accepts this. personel.net nevertheless makes voluntary refunds in the cases described on the Cancellation and refunds page.

8. Buyer's obligations — The buyer is responsible for the accuracy of the jobs they post and for complying with the law in force (in particular employment law, the prohibition of discrimination and personal data protection) and the personel.net Terms of use. Jobs that break the rules may be taken down; rights already used are not refunded in that case.

9. Seller's obligations — The seller takes due care to add the purchased rights in full and to provide the service with reasonable continuity. Rights that cannot be used because of a technical problem on the seller's side are added back or refunded. If a job is rejected before going live, or deleted while awaiting approval, the job right spent on it is returned to the account automatically.

10. Personal data — Order and billing details are processed as explained in the Privacy policy and the KVKK Privacy Notice, and are kept for the legally required period.

11. Disputes — Turkish law applies to disputes arising from this agreement. Where the buyer is a consumer, the Consumer Arbitration Committees and Consumer Courts at the buyer's or the seller's place of residence have jurisdiction within the monetary limits set by the Ministry of Trade; otherwise the courts and enforcement offices at the seller's head office have jurisdiction.
